Terms and Conditions

  1. I Want An Act.com ("IWAA") is an on-line web-site service ("site") which connects individuals or companies wishing to book an act ("buyers") with individuals or companies who wish to provide an act ("advertisers").
  2. Anyone accessing this site, for whatever reason, will be referred to as a "user" and may be referred to in this context as "you" or "your" whereas IWAA may be referred to as "we" or "us."
  3. By your use of this site, you expressly indicate acceptance, without reservation, that you will be bound by the terms and conditions of the site.
  4. No contract is ever entered into between IWAA and you as a user of the site, whether you are a buyer or an advertiser. All future contracts that an advertiser may wish to undertake with the buyer in order to book an act must be effected privately without any recourse to us.
  5. We will show a picture and/or video of the act, if supplied, with attached contact details, until the advertiser removes it. We will not have any involvement in determining the amount an advertiser may wish to charge for their act and will not be held liable for any recourse as a result of the figure the advertiser offers or the buyer accepts.
  6. By your use of the site, you acknowledge that the information made available to you on this site by advertisers is provided by third parties over whom we have no control. You agree that we shall not in any circumstances be liable over the accuracy or incompleteness of the data supplied. Furthermore, you agree that we shall not be in any circumstances be liable to you for any loss or damage at all arising from any inaccuracies, faults or omissions in, or in the provision, the information that leads you to incurring a financial loss or otherwise.
  7. We are unable to enter into any dispute that may arise between any parties who have been introduced through the site. We will neither referee disputes, nor will we have any liability between any parties. The advertiser and buyer will be wholly responsible for the terms of any contractual arrangement between them. In no event will we be liable to you for any loss or damage of any kind howsoever caused.
  8. We reserve the right to remove an act from our database if we feel that the advertiser is acting against the best interests of the site. What constitutes the best interests is a decision purely for us that will be final. You acknowledge through use of the site that there will be no financial recourse or otherwise against IWAA in such circumstances.
  9. No user may extract any information contained within this site for any commercial purpose or purpose without our express written agreement.
  10. IWAA may, from time to time, alter or change the format and structure of our site in an endeavour to improve the service to our users. Your continued use of the site shall be deemed as acceptance of the changes.
  11. This agreement is made under and will be governed by the laws of England.
  12. In providing the particulars of his act, the advertiser shall comply in all respects with the provisions of any statute including any regulations or orders made thereunder and any other obligations imposed by law including bye-laws applicable to all advertisements (including but without limitation the Trade Descriptions Act 1968, the Consumer Credit Act 1974, the Financial Services Act 1986 and the Telecommunications Apparatus Advertisements Order 1985.
  13. The advertiser confirms and warrants that he is (or is duly authorised by) the owner of the act who placed the particulars of it on the site.

The Disclaimer

  1. The particulars appearing on the site do not constitute any part of an offer or a contract.
  2. All statements, pictures and videos contained in the particulars are made without responsibility on the part of IWAA.
  3. None of the statements contained in the particulars are to be relied upon as a statement or representation of fact.
  4. Any buyer must satisfy himself by inspection or otherwise as to the correctness of each of the statements contained in the particulars.
  5. Neither IWAA nor any person in its employment has any authority to make or give any representation or warranty whatever in relation to any act advertised on the site.
  6. In no circumstances will IWAA be liable for any special indirect or consequential damages or any damages whatsoever whether in an action of contract, negligence or other tortious action arising out of or in connection with the use by any person of particulars contained on the site. It is incumbent upon the users of the site to take appropriate dependant professional and legal advice for entering into a legally binding contract.
  7. The information contained in the particulars of acts is supplied by or on behalf of the advertiser and is not provided or supplied by IWAA. While IWAA display the particulars in good faith they do not constitute or form part of any contract nor can IWAA take responsibility for the accuracy of the information contained in the particulars and buyers should obtain independent verification of all statements on the particulars prior to entering into a binding contract with a advertiser.
